City of Fossil Mayor DeLuca called meeting to order at 7:03pm Council present: Ron DeLuca, Dale Odom, and Jack Lorts Staff present: Rick Shaffer, Public Works Director; Teresa Hunt, City Recorder Guest present: Darrin Eckman, Tenneson Engineering; Steven Anderson, Tenneson Engineering. Community present: Marsha Holly, Jan Ward, Terrance Crawford, Bill Brown, Rose McGrew, Bob Loomis, Judy Fessler, Jon Fessler, Kitty Dyer, and Bill Dyer. Dale Odom moved, Jack Lorts seconded: to approve minutes of the September 12, 2006 Council meeting as written. Motion carried by unanimous vote. Dale Odom moved, Jack Lorts seconded: to approve payment of bills as presented. Motion carried by unanimous vote. Old Business: Darrin Eckman of Tenneson Engineering and Steven Anderson, the inspector for the Water Project; were at the meeting to address the issues and concerns associated with the letter from concerned citizen Rose McGrew about R & G Excavating using the City’s backhoe and dump truck. R & G Excavating had given the City a list of “extras” that they were claiming to have done and for these “extras” the agreement with Public Works Director, Rick Shaffer; was that they could use the City backhoe and dump truck. Mr. Eckman went through the list from R & G and determined what could actually be considered “extras”, and what these extras would amount to in monetary value. The Council also went through the process of determining what the use of the backhoe and dump truck would have been worth for the time frame R & G used it. At the end of the discussion, the decision was made that the use of the equipment by R & G was satisfactorily compensated for by the “extras” that R & G did for the City. Water Meter Reading/Charge: Jan Ward and Terrance Crawford is still contesting the meter reading and charges on their water bill for August. After a lengthy discussion they finally agreed to have the meter tested. Steve Anderson of Tenneson Engineering will be doing this. Public Works Director A Fire Extrication Training Class has been scheduled for Sunday October 22, 2006. Mr. Shaffer also reports he will be gone from November 2nd to the 13th; and December 4th to the 15th. Mr. Shaffer extends a “thank you” to the residents of Fossil for being patient with the water project that has been going on, with the issues of the water being off at some inconvenient times. Committee Reports Library Board reports that $142.00 was raised during the Murder Mystery Weekend by selling books. Community Issues/Concerns Bob Loomis requests Mr. Shaffer to dig a couple holes in order to place a gate in the Fairgrounds fence line that goes up to the new reservoir and well in order to keep the fairgrounds stock in. Mr. Shaffer has agreed to meet with Mr. Loomis for this purpose. Judy Fessler asked why RV spaces were allowed to be placed in a Residential Zone, when it is against the Zoning Ordinance. After a lengthy discussion, and it was determined that the City had not received an application from the property owner, and the City had not signed off for building codes to issue a permit to said property owner. The Council instructed the City Recorder to contact the City Planner and the City Attorney to have a letter written to the property owner stating that he is in violation of the City’s Zoning Ordinance and that he needs to come to the City and follow the proper channels of having this property rezoned if he wants to continue with this project. Mayor and Council Reports An email was received from DEQ stating that the City of Fossil Clean Fill area has 7 or 8 dump truck loads of woody debris dumped that is comprised of about 10% prohibited materials such as metal, vinyl, plastic, etc., also 5 old cars that need to be removed. The dumped piles need to have the prohibited objects removed before burning them. The gate that allows access to this site needs to be locked and a key given only to anyone who has an easement. Any other access would have to be approved by the City at the time. Mayor DeLuca reports that he has established a web site for the City of Fossil. The address is www.cityoffossil.org. Mayor DeLuca is asking for anyone with information to be posted on this web site, to contact him and he will put it on. Jack Lorts moved, Dale Odom seconded: to rescind the motion in the September meeting to have an Industrial Park Board. Motion carried by unanimous vote. Jack Lorts moved, Dale Odom seconded: to establish an Industrial Park Special Committee. Motion carried by unanimous vote. Due to no further business, the meeting was adjourned at 9:15pm |
